Terms of Service

These Terms of Service ("Terms") govern all wash-dry-fold laundry and dry-cleaning services ("Services") provided by Posner Industries, LLC DBA Crown Laundry ("Company," "we," "us," or "our") to any individual or entity that submits items for cleaning ("Customer," "you"). By placing an order, scheduling a pickup, or dropping off items with us, you agree to be bound by these Terms.

1. Services

Crown Laundry provides wash-dry-fold laundry services and dry-cleaning services, including pickup and delivery where offered. We reserve the right to refuse service on any item that we determine, in our sole discretion, is unsuitable for processing, including items that are excessively soiled, damaged, infested, or hazardous.

2. Pricing and Payment

Pricing is based on our current rate sheet, which is subject to change with reasonable notice. Payment is due upon completion of service unless other arrangements have been made. We reserve the right to withhold delivery of any order until payment has been received in full.

3. Turnaround Time

We will make commercially reasonable efforts to complete and deliver all orders within the estimated turnaround time provided at drop-off or booking. However, turnaround times are estimates only. Crown Laundry is not liable for delays caused by circumstances beyond our reasonable control, including but not limited to equipment malfunction, staffing shortages, severe weather, traffic conditions, or other events of force majeure.

4. Care Instructions and Item Inspection

Customers are responsible for disclosing any special care instructions, known defects, or delicate conditions of items at the time of drop-off and or our Pick-up. Crown Laundry follows standard industry cleaning practices and manufacturer care labels where present. We are not responsible for pre-existing damage, color bleeding, shrinkage, or deterioration resulting from the age, condition, or inherent quality of fabric, trim, or embellishments, including items without care labels or with labels indicating they should not be machine washed or dry cleaned. We will make the best effort to follow labels and instructions, but it is the customer’s responsibility to disclose them and separate them from other items.

5. Liability for Lost or Damaged Items

While we take great care in handling every item, Crown Laundry's total potential liability for any item that is lost, stolen, or damaged while in our care is limited to ten (10) times the charge for cleaning that specific item. This limited liability applies regardless of the item's original purchase price, sentimental value, or replacement cost, and is a material term of the Services offered at our stated prices. Original receipts of the items in dispute must be presented at the time of the claim. Claims must be made via the email address: info@crownlaundrysd.com or to the customer support line at: 619-662-2005.

Claims for lost or damaged items must be reported to Crown Laundry within 48 hours of receipt of delivery (or, for items not delivered, within 48 hours of the scheduled delivery date). It is at the full discretion of Crown Laundry if the Claims made after this period are honored or not.

6. Unclaimed Items

Items not picked up or accepted for delivery within 30 days of the completed service date will be considered unclaimed. We will make reasonable efforts to notify the Customer using the contact information on file. If the Customer does not arrange pickup or delivery within 15 days of such notice, Crown Laundry reserves the right to donate or otherwise dispose of the unclaimed items without further notice or liability to the Customer.

7. Cancellations and Missed Pickups

Customers may cancel or reschedule a pickup or delivery by providing reasonable advance notice. Repeated missed pickups or deliveries without notice may result in additional fees or suspension of service. The current missed delivery fee is $35.

8. Customer Conduct

Customers agree not to submit items containing hazardous materials, illegal substances, or items that pose a health or safety risk to our staff. Crown Laundry reserves the right to refuse or terminate service to any customer who violates these Terms or engages in abusive conduct toward our staff.

9. Limitation of Liability

To the fullest extent permitted by law, Crown Laundry shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the Services, even if advised of the possibility of such damages. Our aggregate liability under these Terms shall not exceed the amounts described in Section 5.

10. Changes to These Terms

Crown Laundry may update these Terms from time to time. Continued use of our Services after any such changes constitutes acceptance of the revised Terms. The most current version will be made available upon request or posted at our place of business.

11. Governing Law and Binding Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court for Disputes within that court's jurisdiction.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and shall be conducted in San Diego County, California, or by videoconference if the arbitrator and both parties agree. A single arbitrator shall be appointed. The arbitrator's decision shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.

Disputes shall be arbitrated on an individual basis only. Neither party may bring a Dispute as a plaintiff or class member in any purported class, collective, or representative proceeding, and the arbitrator shall have no authority to combine more than one person's claims into a single proceeding.

Each party shall bear its own attorneys' fees and costs in connection with any arbitration, except as otherwise required by applicable law or the AAA rules. Notwithstanding the foregoing, Crown Laundry may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
